AXA APH today announced that it has reached a settlement which has resulted in the discontinuance of Proceedings issued by Biofeedback Research Australia Pty Limited, Dr Keller and Coneview Pty Limited against National Mutual Life Association of Australasia Limited in Federal Court Proceedings No. N1217 of 2000.

Following the discontinuance of the Proceedings, AXA will be making an offer to other relevant Prosperity Bond policyholders who were not party to the Proceedings.

We expect the cost of the settlement and the offer to other policyholders to be within provisions already taken and that there will not be a material impact on our year end results.

The terms of the settlement are subject to confidentiality.
